The FMA treats forex contracts linked to currency exchange rates as derivative financial products and recommends that New Zealanders use New Zealand-licensed providers rather than unlicensed overseas forex services.
Licensed derivatives issuers must meet disclosure, client-agreement, client-money and other licence conditions; suitability requirements apply to retail derivative clients.
An overseas licence or a New Zealand FSP registration alone is not treated as proof that a firm may make a regulated retail derivatives offer in New Zealand.
