Spanish residents can use regulated domestic branches and cross-border EEA brokers, but broker availability and product marketing are not the same thing. Retail CFDs, including rolling-spot forex, remain available only under permanent leverage, margin-close-out, negative-balance, incentive and risk-warning protections. Since August 2023 the CNMV also restricts advertising and aggressive promotion of CFDs to Spanish retail investors and the general public, so a broker may be operationally available while a public affiliate Open Account CTA is deliberately suppressed.
